Terms and Conditions

Both The SailCoach Foundation with NGO Registration No. VO/1868 and SailCoach Europe Ltd, with company number C 59359 whose registered office is ℅ Royal Malta Yacht Club, Waterfront Office, Ta Xbiex Seafront, Ta Xbiex, XBX 1028, Malta. Both organisations hereafter are referred to as SailCoach.

SailCoach’s reputation has been built over 25 years on client satisfaction because we go that extra mile, striving to ensure that you, our client, get value for money. We want you to enjoy your learning experience to the full and return to us time and again as a satisfied client.

Our Terms and Conditions are written in plain English without small print or hidden extras. This is to ensure clarity, openness and fairness. They state our obligations to you regarding every aspect of your training package from the moment you book to the moment you arrive at the airport for your flight home. Similarly, they state your commitments to us when you choose to book one of our training packages.

Your Booking

Once you have paid your deposit, (€250 per person on any clinic, €400 per person on a Coaching Tour and €250 per ILCA or RIB Charter), a receipt will be e-mailed by our head office. This will mean that you have confirmed the booking and have read and accepted these terms and conditions for yourself and on behalf of all members of your party.

Our Price Policy

The prices quoted in e-mail correspondence or on this web site are valid at the time of publication. In the event that prices by our suppliers are increased, we reserve the right to pass on such charges proportionately.

These may be due to

  • Currency fluctuations
  • Increase of taxes or levies
  • Change in the level of accommodation

Terms of Business

Our payment policy is, once a booking is confirmed we take a deposit pre client to secure the booking, with the remainder payable one month prior to the start date of the training or regatta.

Health and Safety

Safety is of paramount importance on all of our training packages. Watersport activities are, by their very nature hazardous and clients and their guardians must accept that there are risks and the inevitable bumps and scrapes. We ask all our clients to comply with all safety and general instructions given by the SailCoach staff.

A full risk assessment has be carried out before any activity takes place at our SailBases. SailCoach coaches hold a current First Aid certificate issued by an appropriate body.

For safety reasons it is compulsory for all clients to wear floatation devices on all training packages. SailCoach reserves the right to refuse permission to participate for any client not wearing floatation devices.

It is the client/parent/guardian’s responsibility to ensure at appropriate clothing is worn and/or available for their sailing and gym activity in all weather conditions.

Medical Information

Clients participating in our training packages must expect to be involved in adventurous and strenuous activity. Clients must be in general good health and must satisfy themselves that the activity is within their abilities.
Clients must make a true and accurate declaration of their health when booking and must make SailCoach aware of any medical conditions they have. SailCoach reserves the right to refuse a booking on medical grounds.

Any medical conditions that a participant may have must be fully disclosed

(1) at the time of booking with SailCoach.

(2) to the coach on the training activity or to the venue manager.

Clients consent to grant permission for basic First Aid to be administered by a suitably qualified member of staff where considered necessary or by a qualified medical practitioner. The client authorises a qualified medical practitioner to provide emergency treatment or medication if necessary.

Weather Constraints

The sport of sailing by its very nature is subject to weather constraints on any given day, however SailCoach will endeavour to go sailing in a wide range of weather conditions. But unfortunately, we are not for safety reasons able to sail in certain wind conditions. We cannot take responsibility for the weather conditions on the day and cannot make refunds for sailing time lost due to weather, we will endeavour to arrange an appropriate catch-up session if possible.

Personal Property

SailCoach cannot be held responsible for any loss or damage to any personal belongings whilst attending SailCoach training. Please ensure that your valuables are kept in a safe place and not in changing rooms or in the boat park.

Unruly Behaviour

Clients are required to have consideration for others on our training packages. If, in SailCoach’s reasonable opinion, a client or any member of their party is behaving or likely to behave in such a way as to cause danger, upset or distress to any third party or damage to property, SailCoach is entitled without prior notice to expel that client immediately. No refunds will be made and the client is liable for any damage caused.

Data Protection

Personal information requested by the SailCoach at the time of booking or any subsequent information is held in its original form and on computer. SailCoach is the Data Controller for the purposes of the Data Protection Act 2001 and will process your data in accordance with the act. SailCoach will not divulge your information onto Third Parties. By providing us with your information to process a booking, you agree that your personal information can be:

1.) Held and accessed by the SailCoach authorised staff.

2.) Used to contact you in the future either by e-mail or post to send you newsletters and general information.

You can exercise the right to opt-out of e-newsletters by sending an e-mail with the subject “UNSUBSCRIBE” to [email protected]

Liability

SailCoach will only accepts liability for personal injury or death of any participant attending a training activity directly caused by its negligence or negligence of its staff.

The client will release SailCoach, its officers, directors, employees, volunteers, agents and sponsors from any liability no matter how arising with their attendance, play, gym training and transportation related to their booking.

Circumstances Beyond Our Control

SaiCoach shall have no liability to clients under this contract if it is prevented from or delayed in performing its obligations under this contract or from carrying on its business directly or indirectly by any acts, events, omissions or accidents beyond its reasonable control, unusually severe weather or default of suppliers or subcontractors.

Equipment

SailCoach will provide sailing dinghies suitable for the type of training booked by clients. Masts are available in the charter package however as you can appreciate it’s very difficult to keep them in good racing order and if clients are particular about their masts we suggest you bring your own.

From time to time we are asked by clients to transport their equipment to other sites, if SailCoach agrees to transport client equipment it is on the understanding that SailCoach cannot be held responsible for any loss or damage to any personal belongings whilst it is in SailCoach’s custody.

Cancellation by SailCoach

SailCoach may occasionally have to cancel your training package. If the numbers of clients on a particular training does not reach a level where it would be economical for us to operate. (A minimum number of 4 clients is required to operate packages as shown on this web site.) We reserve the right in any circumstances to cancel your training and, in this event, we will offer you an alternative training package or give you a full refund of the money you have paid.

We bind ourselves to inform you of such cancellations 15 calendar days before the start date or more when possible. In the unlikely event that we have to cancel your training package (unless the reasons are beyond our control, such as in the event of industrial action, acts of God, natural disasters, terrorist activities, breakdown of ship or aircraft, etc.,) SailCoach will refund you all monies paid for the cost of your training, plus any on usable air tickets.

However, we try our best not to cancel training where possible and this rarely happens once a client’s booking has been confirmed.

Client Cancellation Policy

Should a client cancel a booking prior to the start date of the Coaching Tour or Clinic for any reason (except due to death or hospitalisation), the client shall be liable to pay a cancellation penalty, if less than 60 days’ notice is given.

The cancellation penalty is calculated by having regard to the nature of the booking, length of notice of cancellation and reasonable potential to find an alternative client.

Having regard to the aforementioned factors, the following percentages will be forfeited by the client in respect of the agreed price due to them cancelling their booking based on the number of days between receipt of the cancellation notice and the start date of the service:

60 Days: No fee applies
60 – 40 forfeit deposit
39 – 30 Days: forfeit 50% of the booking price
29 – 15 Days: forfeit 75% of the booking price
14 – Zero Days: forfeit 100% of the booking price

SailCoach has no obligation to give a refund once the training has already started, unless in exceptional circumstances, which is at the discretion of the SailCoach management.

All cancellations need to be made in writing and confirmed by SailCoach with an email.

The payment of any invoice confirms your acceptance of SailCoach’s terms and conditions which can be seen on this website.

It is highly recommended that clients take out travel insurance to protect against loss if for whatever reason they are unable to travel.

Photography and Video Images

SailCoach may from time to time take photographs/video of your training and the use of this data is solely for the purpose of training, promoting and publicising SailCoach events through our literature, websites, press or TV.

Clients/parents/guardians that do not wish to be photographed/videoed must make SailCoach aware of this at the time of booking or in writing before the training activity starts.

SailCoach will hold all personal data in accordance with its Privacy Policy.

Special Requests

Any special requests, such as rooms sharing, rooms with sea/lake view (supplements may apply) meals etc… We will do our best to ensure that your request is passed on to the service provider. The confirmation may only be known upon arrival.

Complaints

In the unlikely event that a client is dissatisfied with the service we provide then please in the first instance raise this with one of our senior staff at the venue. They will deal will the problem in accordance with our policies and procedures. If the problem is not resolved to your satisfaction then please write to our customer services team at [email protected] within 7 days of your attendance on the training package.

We take your views and complaints very seriously and will endeavour to resolve your complaint as quickly as possible. Refunds will only be issued if SailCoach is proven to be in breach of our terms and conditions.
